Our Commitment to Privacy

At  Familee & Women’s Health PLLC (“ClubMeno”), we value your privacy and are committed to protecting your personal health information (“PHI”). This Notice describes how we may collect, use, and share your PHI in compliance with the Health Insurance Portability and Accountability Act (HIPAA) and applicable state privacy laws.

We use your information to provide exceptional medical care, operate efficiently, and comply with legal and regulatory obligations.

How We Use & Disclose Your Information

  1. For Treatment
    We use and share your health information to coordinate or manage your care. For example, your provider may share relevant information with another clinician or pharmacy to ensure continuity of care.

  2. For Payment
    As a direct-pay medical practice, payment activities do not include insurance claims submission but may include secure communication with payment processors, accounting services, or legal and compliance vendors.

  3. For Health Care Operations
    We may use your PHI for internal business purposes such as quality assurance, clinical training, staff evaluation, and improving patient services. Only authorized staff and business associates with valid need-to-know access your information.

Other Uses & Disclosures

We may also share your PHI as permitted or required by law in situations such as:

  • Public health reporting (e.g., communicable disease notifications)

  • Legal requirements or court orders

  • Reporting abuse, neglect, or domestic violence

  • Health oversight activities (e.g., audits, inspections)

  • Law enforcement purposes or to avert serious threats to safety

  • Organ donation or coroner requests

  • Workers’ compensation or similar programs

For uses and disclosures not otherwise permitted by law, including marketing communications as defined by HIPAA, psychotherapy notes, or certain sensitive health information as protected under state law, we will obtain your written authorization. You may revoke such authorization at any time in writing.

Telemedicine consent requirements vary by state and may change over time. The Practice will obtain any consent required by applicable law based on the Patient’s physical location at the time of service.

Your Rights

You have the right to:

  • Access & Copy your health record (a reasonable copying fee may apply).

  • Request Corrections to your record if you believe information is inaccurate.

  • Request Restrictions on how your PHI is shared (though the Practice may not be able to honor all requests).

  • Request Confidential Communications at an alternate address or contact method.

  • Receive an Accounting of certain disclosures.

  • Receive a Paper or Electronic Copy of this Privacy Policy at any time.

  • Right to Receive Notice of a Breach of unsecured protected health information.

  • Right to Restrict Disclosure to Health Plans when you pay for a service in full out-of-pocket, as required by law.

Data Security

We use industry-standard administrative, physical, and technical safeguards to protect your PHI. Access is restricted to authorized personnel only. We also maintain policies for breach notification, encryption, and secure data transmission in accordance with HIPAA requirements.

Changes to This Notice

We may update this Notice periodically. Any changes will take effect for all PHI we maintain and will be posted on our website with the updated effective date.

Telemedicine Privacy & Data Security

By participating in primarily telemedicine/virtual care with Familee & Women’s Health PLLC (“ClubMeno”), you acknowledge and understand the following:

  • Telemedicine involves the electronic transmission of your health information (via video, audio, messaging or digital tools). We use HIPAA-compliant platforms, secure encryption and encrypted storage to safeguard your protected health information (PHI).

  • Your telemedicine encounter will be held with the same confidentiality protections as an in-person visit. You have rights to access your health information, request restrictions, and receive a paper or electronic copy of your records under HIPAA and applicable state law.

  • Although we strive to ensure secure and reliable technology, there are inherent risks with remote services (e.g., network interruptions, data breaches, unauthorized access). You agree that you understand and accept these risks.

  • Telemedicine is voluntary. You may withdraw your consent at any time. If your condition requires in-person assessment, you will be referred to an appropriate facility or provider.

  • The applicable standard of care for telemedicine services is consistent with the standard of care required under applicable federal and state laws and professional regulations for comparable in-person services.

  • The standard of care for telemedicine is the same as for in-person care. We will make reasonable recommendations for follow-up in person when needed to ensure safe care.

  • Your state and federal privacy rights apply. We will notify you in the event of a breach of unsecured PHI as required by law.

  • To the fullest extent permitted by law, the Practice is not responsible for privacy breaches, data interception, or service interruptions resulting from factors beyond its reasonable control, including third-party platforms, internet service providers, or patient-side technology failures.

State-Specific Disclosures

Texas (TX)

  • Texas law requires us to obtain informed consent for telemedicine medical services or telehealth services, and to maintain confidentiality of your clinical information in compliance with federal and Texas law.

  • We are required to meet the same standard of care via telemedicine as we would in-person.

  • You should understand that if you are physically located in Texas at the time of the telemedicine visit, we must hold a Texas license (or otherwise comply with Texas law) to treat you.

Duty to Notify

I agree to immediately notify the Practice if my residency changes to a state not listed above or if I become eligible for Medicare during the term of my membership. Failure to notify the Practice of these changes, or moving to an unauthorized jurisdiction, may result in the formal transition of your care to another provider and the conclusion of your membership agreement.

Our Legal Duties

We are required by law to maintain the privacy of your protected health information, provide you with this Notice of our legal duties and privacy practices, and comply with the terms of this Notice currently in effect.

We reserve the right to change the terms of this Notice and make the new Notice effective for all protected health information we maintain. If we make material changes, we will post the revised Notice on our website and make it available upon request.

Business Associates Disclosure

We may disclose protected health information to business associates who perform services on our behalf, such as billing, data hosting, legal, or compliance services. All business associates are required by contract to protect the privacy and security of your information.

De-Identified Information

We may use or disclose de-identified health information for quality improvement, research, analytics, or operational purposes. De-identified information does not identify you and is not subject to HIPAA restrictions.

Minimum Necessary Standard

We limit the use and disclosure of protected health information to the minimum necessary to accomplish the intended purpose, except where otherwise required by law.
